SCORE™ ACCEPTABLE USE POLICY (AUP)

This Acceptable Use Policy ("AUP") governs the use of the Score™ platform and related services ("Services") provided by Rate Tracker Payments LLC ("Rate Tracker," "Company," "we," "our," or "us").

This AUP is incorporated into the Score™ Terms of Service and End User License Agreement ("EULA"). Any capitalized terms not defined herein have the meanings assigned in those agreements.

By accessing or using the Services, you agree to comply with this AUP.

1. PURPOSE

Score is designed to help businesses better understand their financial health and connect with financial products and services.

To protect our customers, partners, and platform, all users must use the Services responsibly, ethically, and in compliance with applicable law.

2. GENERAL STANDARD OF USE

You agree to use the Services:

  • lawfully;
  • honestly;
  • professionally;
  • securely;
  • in good faith; and
  • in accordance with all applicable agreements.

You are responsible for all activity conducted through your account.

3. PROHIBITED ACTIVITIES

You may not use the Services to:

A. Illegal Activity

  • violate applicable laws or regulations;
  • facilitate criminal activity;
  • commit fraud;
  • launder money;
  • evade sanctions;
  • finance unlawful conduct;
  • misrepresent your identity.

B. False Information

You may not knowingly submit:

  • false financial information;
  • altered bank statements;
  • forged documents;
  • misleading business information;
  • false identities;
  • fabricated revenue;
  • inaccurate ownership information.

C. Unauthorized Access

You may not:

  • access another user's account;
  • bypass authentication measures;
  • attempt privilege escalation;
  • probe for vulnerabilities;
  • access systems without authorization;
  • interfere with security controls.

D. Reverse Engineering

You may not attempt to:

  • reverse engineer the Software;
  • discover source code;
  • recreate algorithms;
  • infer proprietary scoring methodologies;
  • decompile software;
  • create derivative works;
  • benchmark the platform for the purpose of developing competing products.

E. Automated Access

Except where expressly authorized in writing, you may not:

  • scrape the platform;
  • use bots or automated scripts;
  • harvest data;
  • perform excessive automated requests;
  • overload system resources;
  • circumvent API limitations.

Reasonable use of approved APIs in accordance with published documentation is permitted.

F. Malware

You may not upload or transmit:

  • viruses;
  • ransomware;
  • spyware;
  • trojans;
  • malicious scripts;
  • harmful code; or
  • any technology intended to damage or disrupt the Services.

G. Interference

You may not:

  • interfere with another customer's use;
  • disrupt platform availability;
  • perform denial-of-service attacks;
  • intentionally consume excessive resources;
  • abuse customer support systems.

H. Intellectual Property

You may not:

  • copy proprietary content;
  • remove copyright notices;
  • misuse trademarks;
  • redistribute protected materials;
  • create competing products using proprietary information obtained from the Services.

4. FINANCIAL INTEGRITY

Users must submit only information they reasonably believe to be accurate and complete.

You agree not to:

  • manipulate financial information;
  • conceal material information;
  • intentionally misrepresent business performance;
  • submit duplicate funding applications through multiple accounts to evade platform controls;
  • use the Services to facilitate fraudulent lending or payment activities.

5. REFERRAL PROGRAM INTEGRITY

If participating in any referral or partner program, you agree not to:

  • create fake referrals;
  • submit duplicate referrals;
  • impersonate prospective customers;
  • misrepresent compensation;
  • promise financing approval;
  • engage in deceptive marketing;
  • engage in referral manipulation.

6. PRIVACY OF OTHERS

You may not:

  • upload information you are not authorized to share;
  • collect personal information from other users without authorization;
  • disclose confidential customer information;
  • attempt to identify anonymized data.

7. AI FEATURES

When using AI-powered features, you agree that you will not:

  • use AI outputs to create competing financial scoring systems;
  • submit prompts designed solely to reveal confidential algorithms or proprietary methodologies;
  • rely exclusively on AI outputs for decisions requiring professional judgment without appropriate review.

AI-generated content should be independently evaluated before being relied upon for significant business decisions.

8. FAIR PLATFORM USE

You agree to use the Services in a manner that does not materially impair the experience of other users.

Rate Tracker may implement reasonable technical measures, including:

  • rate limits;
  • session limits;
  • storage limits;
  • API usage limits;
  • fair-use thresholds.

9. REPORTING SECURITY ISSUES

If you discover a suspected security vulnerability affecting the Services, you agree to promptly report it to Rate Tracker and refrain from publicly disclosing it until Rate Tracker has had a reasonable opportunity to investigate and address the issue.

You agree not to exploit a discovered vulnerability beyond what is reasonably necessary to verify its existence.

10. ENFORCEMENT

If Rate Tracker reasonably believes this AUP has been violated, we may take appropriate action, including:

  • issuing a warning;
  • requesting corrective action;
  • temporarily restricting functionality;
  • suspending account access;
  • terminating accounts;
  • removing prohibited content;
  • reporting unlawful conduct to appropriate authorities where required or appropriate.

Where reasonably practicable, we will provide notice and an opportunity to resolve violations before taking permanent action, except where immediate action is reasonably necessary to protect the Services, other users, or comply with legal obligations.

11. INVESTIGATIONS

Rate Tracker may investigate suspected violations of this AUP.

Users agree to reasonably cooperate with investigations relating to:

  • fraud;
  • security incidents;
  • abuse of the Services;
  • intellectual property concerns;
  • compliance issues.

12. NO WAIVER

Failure to enforce this AUP in one instance does not waive the right to enforce it in future situations.

13. MODIFICATIONS

Rate Tracker may update this AUP from time to time.

Material changes will be communicated through reasonable means, such as by posting the updated AUP within the Services or providing electronic notice.

Continued use of the Services after the effective date of revised terms constitutes acceptance of the updated AUP.
